Welcome to Grade Tracker Pro ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of the Grade Tracker Pro platform, including all related domains and applications (including but not limited to gradetrackerpro.com, app.gradetrackerpro.com, admin.gradetrackerpro.com, parents.gradetrackerpro.com, tutor.gradetrackerpro.com, and any other subdomains) (the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not access or use the Platform.
Grade Tracker Pro is primarily a student planning and productivity tool designed to help students organize their studies, track assessments, manage tasks, and stay productive. The Platform includes ATAR estimation features that are provided for reference purposes only.
Important: The ATAR calculation and scaling features provided by Grade Tracker Pro are estimates only and are not guaranteed to be accurate.
Predicting an exact ATAR is impossible due to the nature of the scaling process, which depends on the performance of all students in Western Australia in any given year. Our calculations are based on historical data and mathematical models, but actual results may vary significantly.

You must be at least 13 years old to use Grade Tracker Pro. If you are under 18, you must have the permission of a parent or legal guardian. By using the Platform, you represent and warrant that you meet these eligibility requirements.
To access certain features, you may need to create an account. You agree to provide accurate, complete, and updated information and to maintain the security of your account credentials. You are responsible for all activity that occurs under your account.
Your Grade Tracker Pro account is personal to you and may not be transferred, sold, or given to any other person under any circumstances. This includes, but is not limited to:
Violation of this provision may result in immediate termination of your account without refund.
Grade Tracker Pro offers free and paid subscription plans, including monthly, annual, and lifetime options. All paid plans are subject to the pricing and billing terms set forth on our website or in your account dashboard. We use Stripe to process payments securely.
We may offer a 14-day free trial for new users. Monthly and annual subscriptions will automatically renew at the end of each billing cycle unless canceled prior to renewal.
Lifetime plans grant access to the Platform for the lifetime of the service, subject to the following conditions:

| Service lifetime | "Lifetime" refers to the operational lifetime of the Grade Tracker Pro service, not the lifetime of the user |
| No cessation refunds | If Grade Tracker Pro ceases operations, lifetime plan holders are not entitled to refunds |
You may cancel your subscription at any time via your account settings. Refunds are only provided where required by Australian Consumer Law. No prorated refunds are provided for partial months or years.

To ensure data integrity and prevent misuse, subject changes are restricted as follows:
You are responsible for the accuracy of data you enter into the Platform. Grade Tracker Pro is not responsible for incorrect calculations resulting from inaccurate user input, including but not limited to incorrect assessment weightings, scores, or subject selections.
You agree not to:
We reserve the right to suspend or terminate accounts violating these terms.
You may submit academic data, goals, feedback, or messages through the Platform ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and process it solely for the purpose of operating and improving the Platform.
You retain ownership of all intellectual property rights in your User Content.
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your data. Use of the Platform constitutes acceptance of our privacy practices.
All content on the Platform, including trademarks, software, logos, design, and graphics, is owned by or licensed to Grade Tracker Pro and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
We aim to provide uninterrupted access but do not guarantee that the Platform will always be available or error-free. We may perform maintenance, updates, or suspend service without notice.

The scaling data and TEA-ATAR conversion tables used in our calculations are based on publicly available historical data and may not reflect current or future scaling outcomes.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:
You use the Platform at your own risk. We do not warrant that the Platform will meet your specific requirements or expectations.
To the maximum extent permitted by law, Grade Tracker Pro shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Platform, including but not limited to:
Our total liability to you for any claim arising under these Terms is limited to the total amount paid by you in the 12 months preceding the event giving rise to the claim, or $50 AUD, whichever is greater.
You agree to indemnify and hold harmless Grade Tracker Pro, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
We reserve the right to suspend or terminate your access to the Platform at our sole discretion, with or without notice, including if we believe you have violated these Terms. Upon termination, your right to use the Platform will immediately cease.
These Terms are governed by the laws of Western Australia, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts of Western Australia.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Grade Tracker Pro regarding your use of the Platform and supersede any prior agreements.
We may update these Terms at any time. If we do, we will notify you by posting the updated version with a revised "Effective Date" at the top of this page. Material changes may also be communicated via email or in-app notification. Continued use of the Platform after such changes constitutes acceptance of the new Terms.
